Inheritance of flat in cooperative society
My wife was the member of the Cooperative Society under West Bengal Cooperative Societies Act and Rules. She expired in April 2021 intestate due to Covid. She during her lifetime nominated me as her Nominee in the Society's records. We do not have any children. I am her only surviving Class 1 heir. Now, being her nominee, the Society transferred my wife's shares and interests in my favour by discharge on the share certificate and admitted me as member.
Now, my questions are as follows:
1) Been admitted a member of the Society, am I eligible to nominate a person in writing as my Nominee or not?
2) Do I need any legal document in support of my ownership and title to the said flat or just my membership in the Society and the discharged share certificate would suffice?
3) Am I eligible to make a Will for transfer of the property to my niece on event of my death?
4) Am I eligible to gift the property to my niece by executing a Gift Deed?
5) Am I eligible to sell off the property?
Kindly answer the above questions for me take proper legal steps in advance so that the property can pass on smoothly after my death.
