Releasing the private road to Panchayath

My property is located within the perimeter of a family-joint property. As per the deed, i have the right to use the road for commuting. One of the owner is holding a property within this joint property in which heavy vehicles are frequently passing by. It's just a normal hard sand road. Due to this reason, there are so many potholes are formed, getting too much of waterfilled during the rainy season and remains extremely wet & slippery. That makes the other property owners (including me) who bought within this family property more difficult to commute for 6-8 month in an year. We had a meeting with all the owners and put forth the suggestion to hand over the road to panchayath. This will help the common cause i.e; tarring and maintenance. But the actual owner who has the right to handover the road to panchayat is not willing to do so. He wants to keep the status of this road as private to avoid the incursion of the external parties outside the property owners living by. Instead they try to maintain the road by filling or leveling the sand road with some demolished building waste. This makes hard for the cars & the scooters difficult to move smoothly & safely. The main reason for this pathetic condition of the road is due to the heavy duty vehicles frequently passing. They are also not willing to maintain this road properly. We would like to know, is there any legal or official way to submit a complaint directly to the panchayath by all the property owners who bought from the joint property to push the owner to hand over it to panchayath? If yes, please guide. This is located in Kerala.
