Mr. Kaviraj has one wife and a daughter named Miss. Anita. This is also an established
fact that he had no other child as his survivor. He was not so happy with this situation. He
thought as he has no son, there would be no one to take care for him during his old age.
There will be no successor to run his name after his death. One day Mr. Kaviraj was thinking
daughter is the ultimate property of someone else and moreover she could not be a
successor and care taker like son. For this very reason from the very beginning he was
planning and thinking how he should deprive Miss. Anita from her proprietary rights in his
ancestral property. Meanwhile the wife of Mr. Kaviraj suggested him to wait for 2 years
because of Miss. Anita was a minor. Mr. kaviraj agreed to her suggestions, after completion
of 2 years and 8 months, he executed a release deed with Asha of her right to share in the
property. The deed was with legal consent of daughter Miss. Anita as she was happy with
that amount which was received by her father. Meanwhile post execution of such deed Mr.
Kaviraj suffered from incurable disease Ebola and consequently died. Then Miss. Anita
claims her one third shares in the inheritance. On the same time mother of Miss. Anita
counterclaims and sets up the release deed signed by Miss. Anita reminding her that time
that was competent to enter in to the transaction.
