Hi I Have taken a loan from GIC housing in the year 2017 for RS 80L to buy a property with Alliance Builders chennai up on my request bank has released 58L till date . In the year 2019 i have planned to cancel the property because of indefinite delay and my own financial situation . I have written a mail to the developers asking them to cancel and refund the amount . In the mean time pandemic stuck us i have availed morotorium from the bank to my surprise the developers didnt give any update on the cancellation till 2022 March On march 2022 they have written a direct mail to my lender (GIC ) stating that i have raised a request for cancellation so as per the norms they are planning to refund 39L (19 L penalty and cancellation charges ) GIC has now issues 13(2) Sarfasei notice now what should i do Important points to be noted - The above property is still not registered in my name Another important point i have another home loan from the same bank (which has been paid correctly ) will my 2nd property will have an impact I have written to bank stating that i have identified a buyer who is ready to take over the property and asked the bank for waving off intrest charges . My questions are - How sarfaeasi act will happen to a property which is not registered under my name will my other property will have any impact now that am ready to close the loan will bank give time over and above the 60 days notice period from 13 (2) Thanks Ganesh
