Property Dispute between Brothers

My father and uncle who are 73 and 58 old respectively have not been able to resolve the property settlement even after a logical and reasonable offer made by my father, obviously it was not reasonable to my uncle so he did not agree. There are two properties, one is a shop and other is house. My uncle earns his livelihood from that shop and is working from there with complete possession. My father stopped working few years back due to his age, so no longer active in the shop and never goes there. My father is financially supported by his kids. House is equally occupied but not symmetrically and it is a 100 year old property. My uncle wants complete shop with no claims by my father and half of the house, which does not seem reasonable to my father, however he is happy to give the whole shop and only 25% of value of the house. Since there is no agreement, now my father wants to settle this properly and fairly with 50% property with my father and 50% with my uncle, who is acting in a greedy manner. There are no other parties involved. All documentation is intact. How much time such a case will take in District Court? Can the verdict be appealed in higher courts by an related parties?
