Karnataka Societies Registration Act or Karnataka Apartment Ownership Act, which is correct.

We are a 24 year old apartment with 220 flats purchased from housing board. No association was formed by the builder nor did they involve in registering the association under any act. The then owners came together, formed by laws and registered the association with KSRA We did not have any issue so far. We had maintained the apartment adhering to the by-laws we had set. Sale and purchase of the individual flats were happening without any issue. Banks had not raised any concern to lend loans to the buyers either. Recently it came to my knowledge that KAOA ensures ownership on the undivided share of land to the owners which we were not clear of till date. Now we are thinking of redeveloping the property. I feel it is not safe to allow a commercial agency like a builder to handle the building till we have secured complete title of the property. As the registration of the society was initiated by a lawyer, many residents feel a registration with KSRA is enough and it is not necessary to register under KAOA. The sale deed mentions the extent of the land is equally divided among 220 flats. This is irrespective of the area of each flat. I am very sure whether this is sufficient to claim the ownership of the undivided share of land. One thing I would also bring to your kind notice is that, the housing board has not handed over any document to us of the building other than the allotment letter and sale deed. There is no occupancy certificate for the building, as the sanctioned project included many amenities, which was not fulfilled. At the time of handover, the plumbing lines were leaking allowing seepage happening into the building, Fire safety equipment were redundant. Metal window frames started rusting in an year. Letters of request to the housing board has piled up, but with no result. I seek your advice in two things 1. Should we close down the registration with the Karnataka Societies Registration Act and proceed with KAOA. 2. Regard the procurement of the other relevant documents from the housing board to proceed with the registration with KAOA because they have not heeded to any of our requests so far. Please advice
