Can a cooperative housing society change the maintenance bill name when a civil suit is filed

Hi Sir/Madam, Here is the scenario, it's about a flat at Kalyan. There was a family dispute and due to that the family made a registered agreement and decided to give share to the elder son who wanted to live separate. As per the family agreement the elder son was gifted another property as he didn't want to pay the house loan of the Kalyan property and took a properly as gift which was free from any encumbrances. Now after 8 years he has again started to harass his senior citizen parents who are living at Kalyan property as his name was not taken out of the loan structure and is again claiming his rights in the other property as well. As while buying the property he was the first owner and father was the second owner. But the elder son had relinquished his rights from Kalyan property in the family agreement. Now after the father and his younger son has paid out the full loan amount the elder son has suddenly started taking interest in Kalyan property too and has reached out to Society and asked to change the maintenance bill and ownership to his name. Can the society take such actions even after they have been informed about civil suit filed. Kindly advice.
