Cooperative Housing Society

I live in a co-operative society of Mumbai I wonder whether the decision taken by our managing committee is correct. 1) The Managing Committee internally decided to plant trees in the allotted parking slots without consulting the members . MC has planted an Ashoka tree in the marked parking area and that too by digging a concrete floor. After receiving complaint from members that marked parking area is a common place and before doing such activity in it the matter should have been brought to SGM or AGM by Management Committee, they refused to accept our plea. The members also told them that what is the need to break the concrete floor for plantation while we already have a dedicated garden area in the society where gardening can be done, they said it is the decision of the managing committee and every one will have to obey it. I would like to know whether such behavior of the Managing Committee is permissible as per law. 2) A resolution passed in the AGM that any unauthorized use of common space by the member will attract five time penalty for the month. Now a member who renovates a flat by living in it and due to paucity of space the common floor is used temporarily, has been penalized while there are members who have encroached upon the common space by installing permanent shoe racks or their personal fixtures are not penalized. I would like to know Whether the Managing Committee is authorized to impose penalty only on the members who have used it temporarily and not on the person who has encroached upon it. And how far it is valid to impose such fine. Does the temporarily use is an encroachment.
