Building plan: industrial

1. An industrial property ( 400 sq yard)which was allotted by DDA to Mr. Avtar singh on 16th may 1972 at GT KARNAL Road Delhi. conveyence deed was executed by in favour of Sh. Avtaar Singh on 19.09.2011 2. On [deleted] half portion 200 square yard was gfted to one son throughgift deed paying stamp duty on the same. 3 .on [deleted] SPA was executed by Mr. Avtar Singh in favour of Smt. Swinder Kaur attested by Notary Public 4. on 1st June 2018 a gift deed was executed by Mr. Avtar singh through special attoney Smt Swinder Kaur in favour of Smt. Abhinash Kaur wife of Sh. Maninder Singh Jaggi( other son of Mr. Avtar Singh) 5. on [deleted] conveyence deed was executed between Mrs. Abhinash Kaur to Mr. Prateek Mardia 6. Mutation letter id issued by MCD in favour of Prateek Mardia 7. House tax and electricity bills are in name of Prateek Mardia Prateek Mardia approcahed for a loan to Punjab National bank but PNB rejects the same on basis that building plan for 200 square yard is not in place. Copy of Building plan of 400 Square yard is submiited. Questions 1. Can we get a seperate building plan from MCD where the property is not subdivided but gifted to two people in family who further sold property to two different persons and properties are registered by registrar. 2. Why can PNB create equitable mortgage without such plan? 3 If the same is at discretion of bank, then can bank create equitable mortgage on land? Regards Prateek Mardia
