Neighbour Nuisance

Hi, I’m writing from Bangalore. We’ve recently shifted to our own house in a residential society. Unfortunately we’re having a weird situation. We have a rather insensitive neighbour who smokes in the balcony, takes loud office calls, and all other nuisance. This all appears intentional and in a way a deliberate attempt to make us uncomfortable and intimidated. Approaching the RWA is not an option as this fellow is a pally with the members. In fact most of the members of RWA come across as immature and there is rampant groupism. It’s a small society with a group within that forming the RWA ( Residents Welfare Association). They were the early movers into the society. I want to know what remedies do I have if the nuisance from the neighbour doesn’t cease. They’re making it difficult for us to use our balcony areas. We cannot open the balcony door of our kids bedroom. We’ve already spoken to the neighbour about it and since then we’ve started experiencing hostile treatment from rest of the RWA members as well. Please advice on how to tackle the situation. As the legal owners of the property what rights do we have to peacefully enjoy the exterior premises like our balconies etc.
