Builder Putting Interest for Delay in Demand Amount and HDFC Delaying due to slow progress of work

Sir Builder (Conscient Infrastructure Private Limited) is putting us Interest as per Builder Buyer agreement due to Time linked Payment Plan and HDFC is not Disbursing the amount due to slow progress at site. As this is affordable housing project they have to deliver in 4 years and seems to be they will able to do the same. Here is the reply from Builder when we said the HDFC disbursement delay is related to work progress at site “…Any person interested to apply for allotment of flat in response to such advertisement by a coloniser may apply on the prescribed application form alongwith 5% amount of the total cost of the flat. All such applicants shall be eligible for an interest at the rate of 10% per annum on the booking amount received by the developer for a period beyond 90 days from the close of booking till the date of allotment of flat or refund of booking amount as the case may be. The applicant will be required to deposit additional 20% amount of the total cost of the flat at the time of allotment of flat. The balance 75% amount will be recovered in six equated six monthly instalments spread over three-year period, with no interest falling due before the due date for payment. Any default in payment shall invite interest @15% per annum…” Therefore, in terms of the aforementioned Policy, you are liable to make payment towards the remaining 75% of the total cost of the said Unit in 6 (Six) equal instalments over a period of 6 (Six) months. Furthermore, you are also bound by the payment plan contained in the said duly registered Buyer’s Agreement dated 09.09.2020. While we acknowledge that you have availed a loan facility from HDFC Bank, it is pertinent to state that the payment towards the said Unit, in terms of the Policy is time linked and not construction linked. It is stated that our Company is undertaking the construction of the said Complex in terms of the Policy and the construction of the said Project shall be completed within the time period stipulated under the Policy. Furthermore, it is highlighted that both you and our Company are bound by the terms of the Buyer’s Agreement and both Parties shall ensure compliance with the terms and conditions contained therein. Please suggest how to proceed for the same.
