Not Serving Notice period

Dear Sir Request to please guide me on below matter One of my friend has joined the company and signed appointment letter in which for pronation period is written as below given. "You will be on probation for a period of six months from the date of your joining our organization. Management reserves the right to extend this period at its sole discretion. During Probation, this Letter of Appointment can be terminated, by either side, without assigning any reason, whatsoever, by giving 30 days’ notice in writing, or salary in lieu thereof. The salary payable for this purpose will be computed on the basis of your last drawn Basic Salary, Management Allowance and Customized Allowance Pool. Unless, an order in writing expressly confirming your services is served, you will not be deemed to have been confirmed in the services of the company." Now, my friend has completed 7 months and but still confirmation letter is not given in writing nor HR and reporting manager has communicated that my friend has been confirmed. now HR is saying that it is confirmed in system and auto mail is trigerred though system but my friend has not received any auto mail nor HR and reporting manager has communicated or forwarded any mail for confirmation. Considering the above 7 months of service, my friend has resigned with one month notice period as per appointment letter signed. after resignation, HR is forcing my friend to serve 3 months notice period saying that your service is confirmed in system and HR is assuming that auto mail is trigerred. my friend has told them that as below given. 1. I have not received any confirmation letter in writing as per appointment letter 2. I have not received any auto triggerred mail for confirmation of service or even HR and reporting has not communicated on mail. 3. Even though, reporting manager and HR has never communicated/ schedule any call for discussion of feedback and confirmation service. which they have done in system without communication/discussion to me and also i have not filled specified form which need to fill for confirmation of service (as per company policy) in which i have to fill detail and sign and then reporting manager has to sign after joint discussion and feedback of area of development. 4. further, they have confirmed service in system own their and without issuing confirmation letter in writing (as per appointment letter) after that HR and reporting is sending mail to fill form the specified format for confirmation of service to issue confirmation letter in back date which mistake of HR and forcing to transfer mistake to my friend. Now, please guide 1. Is my friend correct to serve notice period of 1 month and can he be relieved 2. alter on can employer send any legal notice for recovery .... is it valid as per contract act and tenable Now need your help and expert advise.
