Wrong transfer of land
I am mentioning about everything..plz Suggest and Help
I Have purchased a plot in haridwar which is a residensial one, no construction on it. when i purchased it has no boundaries even..it is an open land. many other peoples also bought in that land having no boundaries but just paper records or just a symbol for their plot identification is there.
Now from whom i purchased the plot is a Maharaj in haridwar ashram. one other maharaj/swami is also there in the ashram. he also bought a plot just nearby me. his plot no is part of 52 and part of 53..and my plot no is part of 53 and part of 54..
Now the maharaj from whom i purchased the plot , give my wrong possession of plot by 1 Feet in other half of plot no 54, which belongs to other person and give 1 feet of my plot in my part of 53 to his ashram maharaj.(.PLOT numbering is not govt. registered..Original seller just made a rough map for his land and selled plot accordingly. )
So, now question is ..whether i take a Stay Order for my neighbouring plot holder i.e. maharaj's friend who has now made 1 feet boundary in my plot and also file a fraud case on Maharaj (i.e. seller to me, ) for intentially wrong delivery of plot.
Moreover , it may be that i have to return 1 feet plot which is given to me in other part of plot no 54 which is owned by other person..who is my part of 54 plot no neighbour..
One more thing, when maharaj was giving possession of the plot, i came to know about the fact and i also resist..but the First seller from whom maharaj ji purchased, told that after plot no 54..rest of land is also belong to him. and the person with other part of plot 54 will make his plot complete by 1 feet in it..All these conversation was orally not written, is it a minus point ...(plot numbering is not registered but is a open land from whom plot numbering is given by First seller by his convenient)
So, can i also file a suit on first seller with maharaj who told this....and on maharaj from i bought the plot....
if maharaj's ashram friend became legal owner of my 1 feet of plot just by making pillers on four sides of plot...and can I file a stay order on his part of plot until my 1 feet is not recovered..
Whether I am a legal owner of Plot that is registered by maharaj in my name and given me the possession of that plot..
whether my neighbouring person having Other part of plot 54 can take a stay order on my plot for that 1 feet which is given to me of his plot by maharaj ji.. Or he can now have to extend his 1 feet to the land just attached to his plot as told by First seller..
(plz. note that plot numbering is not registered and first seller has given the numbering to his land for his convenient.. plot map is just on a simple paper made by hand)
( The First Selller to all the parties is the Same person and total land belongs to him)
Plot is in Haridwar..
What is legal position and what can i do...
