Compensation w.r.t. Acquisition (in part) of Residential Property for Road Widening
In 2016, the corporation of our city decided to widen the street (where I currently reside) from 25 to 45 ft. The corp authorities initiated action without serving any notice to the residents of the street. Only through the local newspaper we came to know that we had only 4-5 days before they would start carrying out the demolition. Using pressure tactics, the corp commissioner with his team fell some compounds in the street using an excavator and pressurized the residents to carry out initial demolition (in part) of their own properties after which they would demolish the remaining structure(s). Subsequently they constructed the road. I lost about 1000 sq ft in the process. Some 4-5 residents went to the Court and managed to get a stay. I believe there is something called the Fair Compensation Act wherein they are supposed to compensate all the residents, especially those who have lost substantial land. It has been 5 years and I've not initiated any legal action till now. Is there any chance of me being fairly compensated if I file a WP in the High Court? If yes, how much would the compensation be according to law? As I believe the actions of the Corp have been illegal, how can I make my case stronger? Thanks in advance.
