Transfer of property act and society rules

I am a member of a gated community RWA in a major city of Tamilnadu. The builder has completed the 4 phases of construction over a period of 5 years. While the UDS have been transferred and registered in favour of the respective buyers, the space for roads and space for OSR have also been transferred and registered in favour of RWA. For the balance of space [which is 20 %of the gated community] consisting of club house, tennis court, swimming pool, temple shuttle court etc., the builder has given an affidavit on a Rs.2.50 stamp paper expressly waiving his right to claim this piece of land authorising the RWA to use the same exclusively for their use. This is not registered. Please let me know whether this action of the builder in transferring a property by way of affidavit and not by registered deed and the action of RWA in accepting the same without getting the consent of the general body is correct. What legal remedy I have as an ordinary member of the society and purchaser of a flat in this community. Thanks in advance
