Deviation in floor plan
The approved floor plan uploaded in RERA site is showing my booked flat as 2 BHK whereas the sale cum construction agreement executed is for 3BHK .
I think he floor plan is essentially required during registration. The sale deed accompanies with the approved floor plan while registering the property and this will again create problem when it will mismatch during registation .
When the above query was raised to the builder ,the builder clarified that the required floor plan will be developed and stamped by the builder and the same will be attached in the sale deed while registration of the flat.The builder is in the opinion that floor plan does not require approval from any competent authority and it is the layout plan of appartment which needs approval and it is uploaded in RERA site accordingly.
Most importantly, the approved layout plan is showing all the flats as 2BHK and printed drawing available with sales catalogues showing so many 3 BHK in the drawing keeping total no of flats constant. This is obviously raising question on Floor Area Ratio(FAR) which is an important component in issuing OC.
Looking into all these above factors ,kindly clarify the followings:--
1.I have applied for housing loan and nearly one month is over.But the builder could not able to get the loan sanctioned yet.Will there be possibility of stoppage of disbursing housing loan if the floor plan mismatches while coducting field survey ?
2. How 3BHK floor plan will be attached in the sale deed while registration whence 2 BHK flat floor plan is uploaded in the RERA document as approved plan ?
3.As the floor plan is having deviation as mentioned above,will there be problem in obtaining OC ?
Kindly clarify the above legal matter to decide to withdraw or to go ahead with the project.
