Society imposing penalty for parking in common space area

I am a member of a housing society from last 7 years. Builder have not given me parking facilities in society premises and sold at high prices to vested interest members (but i can't have documentary proof). Till today i was parking in a society open space area near turning point. But now society is considering charging a 500 per day penalty for parking to all members who do not park in their allocated space. Is this much penalty justified. also during the purchase the property builder forcefully made me sign a declaration that I don't want parking now and in future. This is to safeguard himself. The builder's son is now chairman of society. BMC has given approval for 48 parkings only. But illegally builder have sold more parking than approved. I have proposed to society either give me a parking facility officially. Else first reoccupy parkings which are not approved by BMC but builder have allocation biasedly . And charge them a penalty also for parking. I don't know how to deal with it. (respond for penalty) I am ready to buy parking space if society gives. But no members at present are selling any parking now. do any means i can ask society to either allocate or charge fix for parking.
