I had applied to a Private Financial Institution for a Mortgage Loan. I had paid the Processing Fee of Rs. 80,000/- . All communication was on email and amount paid was through Bank Transfer to their Corporate Bank Account. I had to then ask them to stop the Loan Processing as they asked for a "Blank Stamp Paper of Rs. 500/- with my Signature and Thumb Impression". Now I need legal help to recover my money. I clearly mentioned in a mail to them that: 1. I have already paid Processing Fees of Rs. 80,000/- (Rs. 5000/- at the beginning of the loan application process and subsequently Rs. 75,000/- on receiving the Loan Confirmation Letter.) In view of the payments already made, I WILL NOT bear this expense. 2. I WILL NOT provide a Blank Stamp Paper with my Signature and Thumb Impression on it, as it can be misused and held against me and also because it cannot be sought by a lending company as per Indian Stamp Act and other relevant statutes. 3. I will hand over the cheques ONLY AFTER signing the physical Mortgage Deed and the disbursement of the loan amount, not before even seeing the Mortgage Deed. In view of these requirements put forth by you, related to documents, which are not in sync with legal requirements of the land and which I do not accept to abide by or concur with, I request you to close this Loan Application with immediate effect and initiate the refund of the amount of Rs. 75,000/- paid as Processing Fees to your company. Please initiate the refund and intimate within the next 48 hours, failing which I would have no other option but seek legal assistance. I have not got any response from them. What should I do next?
