Small shop stalls erected by a non-member on our co-operative housing society land

Dear sir, We have a cooperative housing society in Mumbai. In the year 2003 , On One corner of our open land which was of no use to us , a non-member was allowed to put a stall on this corner of land for a nominal rent. There was no specific agreement registered but an understanding was signed that the society will not object for its presence in our land if any local authority / council ask. This person has paid us the agreed rent till the year 2005 and there after he had stopped giving any rent to society. The managing committee also not followed it very seriously with him for the payment. Now I have following question 1) Whether this stall owner have any membership rights along with our regular members 2) We want now to go ahead for redevelopment. Can this stall owner obstruct our redevelopment by asking for any share in the society's property. 3) Can we do a lease agreement with him keeping him away from the housing society's business? 4) Can we evict him altogether and how Please help
