Delay in delivery of apartment

We are the hapless owners of Hiland Greens project. “Hiland Greens” is being developed by Riverbank Developers Private Limited (RDPL) at Maheshtala, Batanagar, Kolkata. RDPL (Builder) (also known as Hiland Greens) has HDFC Escrow account and they have siphoned off our money a flyover project. In our several conversation with builder Mr. Sumit Dabriwal , he indicated that BBTR Elevated Road Ltd which is 100% subsidiary of Riverbank has used  Rs 268 crore in BATANAGAR Sampriti flyover project , money kept in escrow account is for Hiland Greens projects (2-3 BHK apartments). Money was illegally diverted/siphoned off for Flyover project. Project was supposed to be handed over by 2018 but it is delayed. They registered the project to West Bengal Housing Industry Regulatory Act in 2019 and project completion date is 31st Oct 2021 and they also got extension from HIRA. But as per our GTC ,project was supposed to be over 2018. They also denied compensation to buyers who have 1-2 weeks delay in payments, though they paid full interest for 1-2 weeks delay, but they are denying. Compensation for 2 years delay. 1) Now question is can we directly file a case against builder in Supreme Court instead of going through consumer court ? 2) How much will it cost to fight a case against builder jointly by all owners in Supreme Court ?
