Cheque Bounce
Four years back I issued completely blank 4 cheques (with only signature on it) to one of my close friends against agriculture land I bought from him in Sirsa, Haryana. The cheque numbers were mentioned in land registry that time.
He cleared 3 cheques however one cheque was not cleared. Later on I settled balance payment with him through cash and therefore he did not clear that remaining cheque.
I did not obtain signatures from him for cash settlement and also forgot to recover the blank cheque from him that time. It was all due to close relations and understanding we shared that time.
Due to some other matters later on my relationship with him got bad with passing of time.
Recently he tried to clear that blank cheque (that I had forgotten to recover from him) for 3 lac rupees without any reasons. Luckily amount in bank was not sufficient and cheque got bounced, later on I contacted bank and blocked cheque.
Interesting thing is that he wrote his son’s name on cheque (as I had left it blank at time of cheque issuance) and presented from his account. His son was not the land owner and not a party to registry four years back.
Now my questions are-
1. Can my friend sue me for cheque bounce through his name or his son’s name ?
2. Can I sue him or his son for fraud of misusing cheque ?
