Stilt Parking And Resignation of Chairman, Secretary and Treasurer

Dear Sir, 1. Our building was constructed and sold in the year 2006 and along with the Flats Stilt Parking space was also sold by builder to some of the Flat Owners. From 2006 till today 2020 Flat Owners who have bought Stilt Parking Space from builder are claiming their rights on it. They are saying they pay tax to the Municipal Co-opartion for theisStilt Parking Space and hence it is their own property. Is their any new Rule/Law passed or Amended in Maharashtra Housing ACT / RERA ACT that builder can sell Stilt parking Space legally? Can they still claim Stilt Parking Space as their own property or Management Committee of Society can take control on it? OR if New Act is been passed by Government of selling Stilt Parking Space by builder to the Flat Owners after 2006 then will it be applicable to the Flat Owners by default who have bought Flats before the new rule is passed by the government. 2. Our Position holders (Chairman, Secretary, and Treasurer) of the Management Committe has resigned and elected members have been appointed on that position in our Housing Society. Now the resigned Secretary is not ready to handover the charges from past 2-3 months also she is demanding to give Bank Statement / Pass Book update copy, Resolution Copy, minutes of Meeting Copy etc.... Is this all necessary to give it to resigned Secretary, Is Management Committe bound to give all this documents / Copies to the resigned Secretary. What is the correct proceedure of Handover process. Few of the Committee members have resigned and hence we have elected from the Society Members to form a quorum of 9 members. New elected Chairman and Secretary are from the existing Committee members and Treasurer is been appointed from newly elected member in Management Committee. Please share us the entire proceedure for Point Number 1 & 2, so that we can act on it and run the Society smoothly by convincing our Society Members without any doubts in their mind that may mislead in future.
