Wingwise societies under one housing project

We have purchased one flat in housing project having two phases. Phase 1 (Wing C&D, 84 flat owners) & Phase 2 (Wing A&B, 95 flat owners) on one plot in Warje area Pune. There are some common amenties like Water Storage Tank, Club House, Children Play Area, Gym, Ganesh Mandir, Diesel genset on sharing between Ph 1&2. They are in one common area between two phases. Each phase has separate entrance, separate electricity meters & additional overhead water storage tanks on each wing. Phase 1 completed in 2015 & possession already handed over. Phase 2 Occupancy Certificate received from local body & possession to the flat owners is in progress. Builder formed & registered Co-op Housing Society in the name of project when all flat owners in Ph 1 taken possession in 2016. Ph 2 is registered under Maha Rera Act. Builder collected Maintenance Deposit of Rs. 3.25 Lacs & one year maintenance of Rs. 44 thousand from each flat owner in new Ph 2. Can we demand for a separate Co-op Housing Society for Ph 2 instead if merging members in Coop Hsg Soc for Ph1? How to safeguard maintenance deposit for all 95 members in Ph 2 if we are forced to merge with Ph 1 Co-op Hsg Society? What will be the hurdles in forming new Co-op Hsg Society for Ph 2 members? We need expert's legal opinion or guidence in this regard.
