Divorce in USA legality in India
Hi, I am finalizing a divorce in the USA. Both husband and wife are participants and responded to the US divorce and are moving to a mutual consent settlement with a one-time alimony payment to close the divorce. The husband is US citizen and wife is Indian living in India now.
I have 4 questions:
- If we sign the Marriage Settlement agreement and I (husband) send the settlement money via US court jurisdiction, is it valid in India?
- If we sign the MSA using esign instead of hand-signed and notorized copy, is it legal in India? and cannot be challenged in the future? I want to make sure the Indian courts recognize this and I am not held accountable
- Can you send the money to a third party (relative), since the wife does not have a US bank account? This is by the written request of the Wife to a specific third party. Would this cause issues in India later on
- If I send the settlement alimony (one time) to India to her, is it taxable?
All these are allowed and included in the MSA, but I want to make sure there is no future issues in India once I send the settlement amount. I do not want to be in a situation in the future where I land into legal trouble by the wife in case she uses these uncertainities to create more legal trouble for me.
