Documentation Process - Adjacent Property
Dear Lawyers,
I have two adjacent flats that has already been combined by merging the living rooms. Please note that the wall that was modified is NOT a load bearing wall or does not effect the beam or pillar in anyways. I bought the property in as is condition where the previous owner had already merged the flats, both the flats have separate agreement, have separate society bills & electricity bills but are registered to me as the same owner.
Now few residents of the society have raised objection to the merger of the flats, I wanted to check with the respected lawyers in the forum.
1) If the members are justified in raising an objection?
2) Is there any documentation that I need or should have taken into consideration while purchasing?
3) I have a certified architects copy that was provided by the previous owner to me during the purchase & is also available in society records.
4) I also have the copy of society approval for merger that was provided by the previous owner.
As of now the society managing committee has had no objection, only 2 of the residents have raised this concern. What exposure do I have in this case & is there anything that I need to do to be on the safer side?
Thanking you in anticipation.
