Can i stop emi or get waiver on my home loan emi- how?

Dear Lawyer, I have booked a flat in Noida (U.P) in the year 2011 at a total cost of ~ 50L from the builder named - "Amrapali". The project is quite delayed and by year 2015, made a total payment of ~90% of the flat cost. I have taken home loan (~20 Lacs) from a private bank and had been paying pre-emi from last 8-years now. The current situation is: 1. No construction is happening from last 2-3 years. 2. Builder has declared itself bankrupt last year. 3. I had been living in a rented flat, paying the rent + the EMI. 4. A case is undergoing at H'able Supreme court. 5. There is no clarity at all, if and when the construction will happen or not happen. My queries are: 1. Can the EMI be stopped or waived off by bank? How this discussion should be approached with Bank ? Can you please advise the process ? 2. As of today, I have paid close to Rs. 10 Lacs in lieu of pre-EMI (interest) to Bank against the home loan I took (i.e. 20 Lacs). Since there is no visiblity of the construction to happen or completion time, what should be best approach to close the loan / get it waived off ? Can a one time settlement happen with bank, wherein they can consider the already paid amount (10L, as interest) and additional (10 L) I can arrange from friends/relatives to pay and settle all with bank. I am very much tempted to stop paying EMI but it may have a wider impact in the long run / future, as i got to understand from few of my friends/family. Please advise on how best to come out of this mess, created by builder/bank but troubling the buyers the most. Thanks in advance. Raj, Noida, [deleted]
