Transfer of property

My father passed away 3 months ago. Our family now consists of our mother, my younger brother and myself. Our father and mother, before his demise, lived with my brother. Our mother continues to live with him. Our family house is registered on father's name. It has been on rent approximately for last 10 years. During the whole period my brother collected the rent. He also took care of our parents. After the father's death I discussed with my family what should be done with the property. Our mother wants the property to be equally divided between me and my brother. My brother is not interested in any kind of division. His position is to transfer the property on mother's name and the house should remain on rent and he will continue to collect rent. I object his position. I need property / funds to buy property as currently I live on rent. All the property documents are with my brother. He behaves rigid and is unwilling to discuss this matter further. I know legally I have the right to the property. I have few questions regarding the matter. How can I exercise my right to the property? Within how many days do we have to transfer the property after the death? How can I produce the property documents in the court as they presently are with my brother? How much time will it take in the court to divide the property as per the law? After I get my share how can I sell my share of the property if my brother may be unwilling to sell his share?
