Construction on personal property

Dear Sir, I am from Kerala. Now a days, environmental issues are the ones which are manipulated and mis interpreted by the govt officials and use it as a source and a medium to make some fast buck. Kerala is the pioneer in this activity. While politicians can get away with anything, the poor man suffers without any justification. I am sure you will know the latest issue where Supreme court has ordered the demolition of 5 flat towers in kochi since it has been built near the back waters. while upholding the environmental issue right, what has the buyers done to be punished? Who are the builders, who gave the permission and sanction, which ministry and ministers were in power during that time etc are to be considered and they are the ones to be punished rather than making the owners run to the court to solve a problem. Anyway mine is a query not on this matter but with some reasons of the same kind. I have a property in my name since 60 years which my parents had purchased. he built a house and we lived in that place for more that 45 years. it is a fully compounded property. 10 years back I decided to demolish the house and build a bigger one. There is a river running behind the property which is 10 mts away in one corner of the property and more than 40 meters from the back wall. As per the present land development rules, a building can be constructed leaving 50 meters minimum from the river!!!!!!!!! from my 20 cents of the property, 15 cents to be left!!!! leaving all the illogical misinterpretations by the govt departments, My query to you is as follows. If I leave the said space as per rule for the GROUND FLOOR, which is considered to be the environmental ISSUE, the sanction can be obtained. Can I construct (like the permission given in Mumbai for construction) second or third floor 'extending backwards above the land of say 10 cents, where the building does not touch the land for environmental DISASTER AS THEY PROCLAIM? I would appreciate if your thoughtful guidance can be given. as such thousand of people in Keerala are suffering becausse of this issue near the rivers and canals etc and no one has thought of a solution to this man made issue.
