Eviction

I am am a Senior Citizen & my wife is also a Senior Citizen and having a flat in my wife's name in Bangalore. This was purchased by making payment from our joint account. Our son is doing job and living in the same flat. The son selected a girl on his own and after marriage started living in the same flat. After 4-years they have differences and every day fighting is going for odd reasons vitiating the house peace/ environment. The flat can’t be partitioned for separate living of two families. Our son has requested for mutual divorce, which his wife has declined. There after my daughter-in-law has filed a domestic violence against three of us making untruth wild allegations since April'18. We have proved to the court that all the allegations are frivolous & untruth during many hearings till 10/05/2019. Court will pronounce verdict in June'19. We want to live in peace and requested the son to move out of the flat along with his wife, which the boy has agreed, but the daughter-in-law has declined to go outside fearing loss of property right. I want a legal advice from legal professional / practicing advocate on the following points: • Is not the daughter-in-law duty bound to live in conjugal right with her husband? • When the boy is ready to move out, how the daughter-in-law can claim property right now & want to stay back without her husband at the mother-in-law's flat, which is not hereditary owned? • Does it require an eviction notice to be served to boy only or in the name of both? • If the boy moves out and his wife does not, then what are the options left for her eviction? What are the options left with us to live in peace for rest of living years? It will be nice, if anyone can recommend an advocate practicing in Bangalore for good guidance.
