......Petitioners
versus
State of Punjab and others
.....Respondents
CORAM: HON'BLE MR.JUSTICE SUDHIR MITTAL
***
Present: Mr. Parvesh Sachdeva, Advocate
for the petitioners
Sudhir Mittal, J . (Oral)
The present petition has been filed seeking protection of life and liberty
as the petitioners fear that respondent No. 4 (mother of petitioner No. 1) will cause
them bodily harm as their marriage has been performed against her wishes.
Notice of motion.
Mr. Luvinder Sofat, AAG Punjab, accepts notice on behalf of
respondent-State.
Petitioners No. 1 and 2 are major and the same is proved by their
Aadhar Cards (Annexures P-1 and P-2).
Without commenting upon the validity of the marriage between
petitioners No. 1 and 2, I deem it appropriate to direct respondent No. 2 to ensure
that life and liberty of the petitioners is protected by providing them adequate
protection after carrying out a threat assessment and as and when deemed
appropriate. The representation (Annexure P-4) already made as well as the facts
mentioned in this petition shall be kept in mind by him.
The petition is accordingly disposed of.
At this stage, Mr. Judgepreet Singh Warring, Advocate has put in
appearance on behalf of one Partap Singh son of Kartar Singh and submits that his
client is married with petitioner No. 1 and her alleged marriage with petitioner No. 2
is illegal.
The present petition has been filed for grant of protection of life and
liberty of the petitioners. That is the limited extent, to which relief has been granted
to the petitioners. I am not commenting upon the validity of the marriage and
Partap Singh son of Kartar Singh would be entitled to initiate appropriate legal
proceedings under the law.
