IS NOC from old builder is necessary?

Dear Sir, There are many societies who were given the consents to various developers in 2008 – 2009. But due to the changes happening in DC Rule, specific 33(5), redevelopment projects in Mumbai were totally stop. Meantime, whatever projects were submitted to MHADA, MHADA rejected all proposals somewhere in 2009 and return back to concern societies. Now new DC Rule is declared and policies are very much cleared. Since there was delay in project, economical changes, market changes developers are started submitting their revised proposal to their earlier societies and tenants. But there are many Societies are having doubt with their earlier developers. This may be due to the change in market, new rule inlcuding MAHARERA. Also now everybody have to go through the new redevelopment process (as earlier proposal itself is not phigible). We have couple of small queries which are mentioned below: 1. Can societies issues THREE Notice and terminate the earlier developer ? (irrevocable Consents signed around seven to nine years ago. Some of the societies are also signed and registered Development Agreements. As there are many changes happening in 33(5), developer have not took any step about the redevelopment of these projects since the rule changes started. There is no any process is done by developer as the project was not profitable to him since he took the consents / registered development agreements – for some of the societies). 2. As the earlier proposal itself is not phigible due to the changes in base rule – 33 (5), redevelopment have to start from beginning. Can societies select new developer? Is it necessary to give the termination letter to old developer? 3. In case, if Societies select new developer, is NOC from old developer compulsory ? Kindly help us to get information about the same. Is answers for the above queries available to any (official govt.) website? If yes, please provide the link for the same.
