Time is of essence

I had bought a land from one person at a cost of amount x per decimal and had planned to start a school on that. I have already paid 50 percent of the sale amount. In the sale deed it was mentioned that the seller shall process for the approval of school and shall hand over the approval to me within a period of 6 months. It was also mentioned that if the seller fails to provide me with the approval within the prescribed period, the price per decimal of land shall be x1 and not x( x1 being lower than x). The seller had got the approval within that period but it was in the name of the seller which is why I asked her to get the approval in my name which the seller failed to furnish within that period. Now the seller has filed a case against me in a court for non payment of the sale amount. What will the court do - 1. About the cost per decimal- will it be ruled as x or x1 per decimal 2. Will my non payment be considered a breach on my part - will I have to pay for the damages 3. Or will the seller be charged for breach- since he failed to give me the approval within that prescribed time
