I am working in a company, i had signed a bond with them the agreement are as stated below:-
The employee will be on probation for a period stipulated in the appointment letter.
5. During probation, the employee shall be required to undergo training. This may comprise of classroom training and/or hands-on training.
6. Where the employee has not shown sufficient progress during the stipulated probation period, the probation may be extended for such further period not exceeding nine months in all.
7. If the employee leaves his/her employment with Odyssey within a period of 15 months, he/she shall be liable to repay the cost of training along with the remuneration paid during the probationary period or the extended probationary period as the case may be. The sum repayable will be calculated on a pro-rata basis taking six months as the unit. Thus if
a. The employee leaves before completing the probation or within the first six months, he will repay the entire remuneration paid during the period of probation along with the cost of training. b. The employee leaves after six months but before twelve months he will repay two thirds of the remuneration paid during the period of probation along with the cost of training. c. The employee leaves after 12 months but before 15 months, he will be liable to repay one third of the remuneration paid during the period of probation along with the cost of training.
The cost of training is the actual expenses incurred by the company on training the employee during the probation period. The period again being reckoned from the day he/she completes the probation till the date of leaving excluding any leave without pay.
The employee may note that this is not by way of a penal payment but repayment of the unrealized portion of the cost incurred by the Company on the employee by way of training and facilities.
But now i am really stressed about the job it is completely different from what i was told in the interview, can i break the bond and also i have come to know from my seniors that they claim an amount upto 3 lakhs for breaking the bond saying that the training cost is upto 3 lakhs and also they have my graduation, ssc and hsc marksheets.
Can anyone please help me out.
