Seller & Buyer signed Sathe Karar (MOU) with following terms & Conditions in 2015. Seller & Buyer both agreed to go into an agreement for price decided per guntha. Seller would measure the land as per 7/12 utara, built compound to the land & build walkway cement bridge for the access to the said property. All the above expenses would be borne by the buyer. Thereafter sale deed would happen and balance amount would be paid off. The seller has agreed to the terms and condition and received token amount. However during land fencing villagers objected for building fence and destroyed some part of the fence. Later they filled the petition in court. Reason for breaking the fence and court petition is they need road to access to their field from our land. Therefore the deal has stuck. Buyer says first build the fence and bridge then i will go ahead for sale deed. As I cannot fulfill buyers demand i want to cancel the Sathe Karar (MOU). Buyer is not ready to meet me as i want to cancel the Sathe Karar and return his token money. is it legally possible for me to cancel sathe karar. What steps should i take to cancel it. Is there any way out.
