Criminal case for motor accident

Hi, My wife has met an accident while riding her Activa back from office. She was hit by an Omni Van approaching from the opposite side where the driver accelerated negligently. She has suffered dislocation and fracture in her femur bone which required a surgery to put implants. A FIR was registered the next day but there hasn't been any arrest in the case. The owner of the vehicle is a bakery shop owner and the driver was his employee. The vehicle isn't insured and I am not sure if the driver had a driving license. So far police has just seized the vehicle and registered a criminal case in the court. There is no other progress and the bakery owner is very confident that the law isn't strong enough to hold him guilty. My wife has had a torrid time since. She has gone through excruciating pain, not to mention the implants and the fracture which has weakened that joint for her life. She is also very traumatic post the incident. I have shelled out more than 2 lakh for the hospital treatment and she would require 2 months of physiotherapy. The injury would have some long term implications for her as well. She would not be able to join office for 2 months which would damage her professional life as well. Her vehicle is also severely damaged. She has a health as well as vehicle insurance. In such a case where the victim hasn't died but has suffered a heavy psychological and physical stress and has had his professional and personal life compromized how does court quantify the loss and how is the quantum of the punishment decided? For all the physical and mental stress what does Indian law offer me? The van owner isn't willing to compensate me as well as he is confident that he will get through unscathed. What are the options I have? I want to hold him guilty for prison and want a compensation of 5 lakh to set a precedent.
