How to disallow request by the plaintiff to withdraw the P & SC petition converted to original suit

My father expired in 2012 leaving behind no will. A few months back, my mother filed a probate and succession petition in the district and sessions court with a will purportedly written by my father which was actually forged (with the pressure of my only brother). This was without my knowledge and I was not even served summons although I work in a govt. office. But I came to know about the petition through one of my relatives who read about it in a newspaper and I objected during the court hearing through a lawyer that it was a forgery. Then the petitioner's lawyer wanted the petition to be converted into an original suit since I had objected as the defendant. Then, the petitioner's lawyer kept on pleading for time for 5 to six court hearings each time telling the judge that he will pay the court fees next time. And now he has filed a memo to allow them to withdraw the petition to file a fresh suit. What all options do I have to object to this and what can I be able to do about the forged will?
