Use of Parking Space

Sir, I am flat owner of a small G+3 residential building in Kolkata. I have two brothers and one sister who also own separate flats. I along with my brothers and sister were land owners of the property as legal heir to our parents. We executed an unregistered Development Agreement with one Developer and executed one power of attorney with one partner of the Developer. The power of attorney was not irrevocable and does not contain any clause related to or linked to the Development Agreement. PoA gave power to make sale deeds , but it was mentioned that consideration should go to land owners account. During signing of Development Agreement in early 2005, it was also agreed orally with developers that I will buy one car parking space out of Developers allocation. Later when they finalised and informed the price I gave them advance and they issued a receipt of money without mentioning the total price. Finally after building is constructed, when they were delaying handing over of the garrage space I sent lawyears notice mentioning apprx sqft, and the total price agreed. The Developers did not answer this notice and after several months I filed a title suit of specific performance and Injunction. Injunction petition was vacated initially in 2008 and I went to appellant court within required time. The appellant court passed an order of permanent Injunction in 2012 and but meanwhile in 2009 they sold the property to some outside person abusing the power. I went to appellant court for specific performance of contract and contempt of court. I am waiting for hearing and the buyer is now under injunction. The buyer of above garage space and owner of another garage space (this second garage owner is also apartment owner} are using the garage spaces for commercial purpose and making various inconveniences. Can the other apartment owners together with my siblings can now in 2017 proceed for legal action against use of parking space for commercial purpose
