Painting Clause in Rental Agreement
Hi - there is no specific mention in my contract that it should be painted again on vacating or the painting charges will be deducted. Is my landlord justified in asking me for tha painting charges orf . He gave it in painted condition The language is like that -
15. HANDING OVER THE SCHEDULED PROPERTY: On expiry of the term of this Lease or on earlier determination of the lease, the Lessee shall forthwith remove themselves and their respective belongings, articles and things and must deliver peaceful vacant possession of the scheduled property to the Lessor in the same original condition in which it was leased to the Lessee only with reasonable wear and tear. Lessee shall indemnify the Lessor against any loss or damage that may be suffered by the Lessor due to the conduct of the Lessee, Lesses’s family members, servants, visitors, invitees and agent. Lessee undertakes, if such damage is caused to the schedule property, to repair the damages to bring back the scheduled property to the original condition and in all cases Lessee shall handover back the scheduled property as it was received.
In the event that there are any damages to the scheduled property during the occupation by the Lessee, the Lessor shall not be required to refund the security deposit till such time that the damages are rectified. During such period, the Lessee shall continue paying the Lessor at the rate of Rs 39,000/- per month to the Lessor. The Lessee further undertakes to rectify the damages within a period of 3 month from the date of vacating the premises. If the Lessse fails to rectify the damages within this period, then the Lessor shall have the right to use the security deposit toward repair charges. The Lessee further agrees that in the event the said deposit amount is not sufficient then the parties agree that the Lessee shall compensate the said Lessor with respect to the same.
The Scheduled Property is Villa #25, Vaswani Ashton Woods, Survey No. 38/2, Kariyammana Agrahara, Bellandur Post, Bangalore - 560 103. The scheduled property is provided with:
? Built-in wardrobes in all bedrooms
? Dressing table and chest of drawers in the master bedroom
? Built-in bar and book counter beneath the staircase
? 6 ceiling fans
? 3 water heaters in the bathrooms
? Chimney, gas stove and built-in cabinets in the kitchen and
? Light fittings
? Curtain rods
The Schedule Property is fully painted, cleaned and received by the Lessee in good condition.
