Land Matter!

Hi, Though I'm from Kenya, this surely has been my site of interest especially making reference info concerning legal matters. Lets dive in straight to the question. My father bought a land from an Indian man in 1990 here in Kenya measuring 80x100 m2, whereby an extension of Leasehold Title was prepared and processed (the Indian Land Transfer Act) so as to enable my father to fully occupy the land by way of development. However, in the year 2014, August, his brother forcibly entered the land claiming the share of it. On this year September,2017 by using a copy of Land Title Deed which he claims to have been given by the Ministry of Lands, Kenya, he went to the court of law and obtained a temporary court order against any development by my father. Though he can't provide any proof of the legitimacy of the said Title Deed, this man has actually caused untold suffering since my father had already leased out the parcel for a commercial building to be constructed whereby all the materials are on the site! Though the case is bending at the Environment Land Court, Kenya, we've got a view that at no day National Land Commission, Kenya could issue two ownership documents to two different entities, i.e. My father (Paul) with the Leasehold Title Certificate and his brother (John) with the Land Title Certificate. We've been strategizing legal ways on how to deal with Mr. John concerning his criminal activities which he's trying to justify and use the court of law as a suppression tool. Can you and anybody be of help. We really would like to put up a 15 storey commercial building as we've already completed the necessary documentation on putting up the structure with all government agencies. Thanks, Regards, Erastus
