Service matter

I am Central Government Employee. I have been placed under deemed suspension following my arrest in a criminal case. I was released on bail thereafter. My question is related to applicability of Rule 10 (6) and 10(7) related to suspension under CCS (CCA) Rule 1965. What Should be the effective date from which period 90 days would be counted in case of suspension under rule 10(2) i.e. deemed suspension. As per para (7) of the Judgement dated 28.07.2010 of Hon'ble High Court, Calcutta, 90 days should be counted from date of suspension i.e. from arrest of an officer. However, rule 10(7) of CCS (CCA), 1965 states as following: Provided that no such review of suspension shall be necessary in the case of deemed suspension under sub-rule (2), if the Government servant continues to be under suspension at the time of completion of ninety days of suspension and the ninety days period in such case will count from the date the Government servant detained in custody is released from detention or the date on which the fact of his release from detention is intimated to his appointing authority, whichever is later.” Please clarify the same. Judgement of Apex Court or any other High Court may be proved in this regard, if any?
