How to defend NBW in this case, I am arguing on behalf of State?

A complaint was filed in respect of dishonour of a cheque No. 123456 drawn on Bank of India, Bukru, Ranchi dated 6/10/15 for Rs.19,083/- by one Hulash Sahu in favour of Vishal Chand. When the cheque was presented for payment it was returned due to insufficient funds along with return memo dated 5/11/15 and again on 15/11/15. Thereafter a legal notice was sent to Hulash Sahu by registered post with acknowledgement due at the address available in the records of the Bank. However, the cover was not received back. Because no payment was made within the stipulated time Vishal Chand lodged a complaint against Hulash Sahu before the court of the Ld. Chief Judicial Magistrate who after making due enquiry and examining the complainant on oath took cognizance of an offence under Section 138 of the Negotiable Instruments Act. That Hulash Sahu upon coming to know about the case appeared before the court and prayed for bail which was allowed. Hulash Sahu was unable to appear before the trial court on 05/01/17 and accordingly had given instructions to his counsel and prayed for dispensing with his appearance. Unfortunately, the counsel could not represent Hulash Sahu with the result that the judgment and order of sentence was passed by the court in the absence of Hulash Sahu and he was convicted by the Ld. Chief Judicial Magistrate on 05/01/17 and sentenced to undergo simple imprisonment for six months for the offence under Section 138 of the Negotiable Instruments Act. A NBW was also issued against him on the same date to secure his presence for undergoing the period of sentence. Being dissatisfied Hulash Sahu filed an application before the Court of Sessions praying for suspension of the sentence passed by the trial Court till the disposal of the criminal appeal. However the Ld. Sessions Judge vide order dated 13/02/17 was pleased to dismiss the application for suspension of sentence, mainly on the ground that a NBW is in force against him. Aggrieved, Hulash Sahu has approached the Hon’ble High Court of Jharkhand, Ranchi invoking its revisional jurisdiction.
