How to get the NBW quashed -420,406,323,120b,504,506

420,406,323,120b,504,506 is under which the case has been falsely filed by the opposition. the case goes like this there was a fir lodged by the opposition stating that we are to pay him 15 lacs and when the other party asked for the money we started hurling abuses and threatend them for life.they also applied for a caveat in high court. to counter it we approached the high court admitting we have to pay them 12 lacs as we have returned 12 lacs. court disposed the petition advising us to pay up the amount by november end in 2017.then struck the demonetisation drive and we could not arrange for the money in stipulated time.for which as per the court order we paid a cost as advised by the court in cjm court. in the meanwhile we kept aaproaching the opposition party to take the payment in parts but they said its not 12 lacs any more we will have to pay them 28 lacs.one of our lawyers suggested that you relax and they will themselves take the money. In the meanwhile the investiagting officer in the case got changed and he within a time of 7 days got the NBW issued against four of the accused in the case.ALSo the highlight is he got this issued without crpc 41a being there in the court file. evidence of which has been procured through the question we have put up in court. and one of the accused also got arrested and fretting the arrest others went absconding. during the bail plea of the accused arrested which also happened after 21 days we showed up with the drafts of 12 lacs and 2.4 lacs for interest if any and same was accepted by the opposition party in the court in front of sessions judge. investigating officer is now not filing the chargesheet so that we can challenge it and niether is the opposition party writing a settlement despite accepting the money. please suggest me a way: either to convince the IO to file the chargesheet as he says he is ready to initiate the process of 82-83. quashing of NBW from allahbad high court stay on NBW till the time charge sheet is filed. also please note there is no provision of same day bail in teh court where the matter is subjudice.
