I had signed an agreement with a contractor for constructing a house in April 2014 at Bangalore and made 80% of the payments according to the payment schedule. At times we made some advance payment to speed up the work as per the request from the contractor.Once he collected excess money from us, he slowed down the work and was irregular in sending workers.In between he delivered all substandard building materials and cheap quality wood and we forced him to change the materials.But he continued the same in delivering the materials.When we questioned, he abruptly stopped the work and avoided all communications from us. He completed the structure and a part of plastering and delivered the flooring material and approximately 70% flooring also completed.We tried to communicate through Phone and e mails but no avail. Then we visited their office to discuss on this issue, they tried to manhandle my wife and subsequently we filed a complaint in the nearest police station.Police summoned them and they came and apologized for the incident , as we had to complete the construction we also did not pursue the case. Even after this they were not willing to start the construction. Finally we sent a termination notice and requested for a chartered engineers audit report, but the contractor did not responded or honored our request to appoint am chartered engineer, We availed report from a chartered engineer after assessing the construction. Based on this report and all other documents like payment receipts,photographs etc ,we filed a case in Karnataka state consumer redressal forum in 2015.Till 2017 January the contractor or his advocate never attended the case. On 23rd Jan 2017, as per the court direction we submitted an affidavit and that day the opposite party appeared and submitted their version. In this situation what should be our next step and what are the evidences and documents we need to prepare and submit? Is there any time frame to complete the case?Opposite party did not attended the case for almost two years and now they came to appear, We find this as a tactic to delay the proceedings. How can we tackle this? They claimed in their version to the court that they filed a civil suit against me but I do not have any information or got any notice till date. When I checked the case status online, that particular case number belongs to some other case and parties. How should I address this? Awaiting your kind suggestions... Ambu. Bangalore
