Refund Request to Builder

Dear Sir, This is in regards to my booking done one of the reputed builders in Sep'2014 for a 2 BHK flat of 1240.00 Sq.ft. As per commitment, I have paid every instalment on time. I paid Rs 25,30,427/- to the builder till Nov’15. In July’16, I approached HDFC bank for a home loan for further payments. HDFC refused to disburse my approved home loan because of the slow pace of construction by the builder (I have the e-mail from bank). I decided to visit the property myself in July’16 and was baffled to witness that the builder was yet to finish with the casting, which clearly indicated that the bank was correct in stopping the disbursement. Under these circumstanced, I had decided to cancel my booking and gave a cancellation request to builder on 14th July’16. I received a startling reply from the builder stating “You will get your money after deduction of the cancellation charges mentioned in the agreement, which is 10% of the total cost of the property”. Would like to highlight that the builder has prepared the agreement on 16th Jan’17 and sent the same to me on 21st Jan’17, six months after my cancellation request.. I approached the builder over the phone to clarify my following question, to which I didn’t get satisfactory answers:- • How can they deduct 10% of the total cost of the property when they have prepared the agreement 6 months after my cancellation request?? • The agreement was shared with me after 2 year 3 moths of the booking date. How will customer trust the builder under these circumstances? • I have not signed the agreement neither the builder has, hence the clause of penalty on cancellation should not arise? • The builder is still tenacious on the point that they would deduct around 6 lacs from the total amount of Rs 25,30,427 , as they got me signed a GTC form during the initial booking, which was having this 10% clause. • As a customer, I knew that the agreement between the buyer and seller is the main deed, which the builder never shared with me. • I strongly believe that the GTC form is a scheme from the builder’s side to entrap their customers. They get the GTC signed by the customer during the booking and deprive them from seeing the actual agreement. Kindly suggest.....what are my legal options
