Sir, kya mujhe sabhi mein answer **NO** dena hai. Sir jab police verification aayegi tab mujhe kya karna hoga ? Plz tell me
(a) Have you ever been arrested?
(b) Have you ever been prosecuted?
(c) Have you ever been kept under detention? → No
(d) Have you ever been bound down? → No
(e) Have you ever been fined by a Court of Law? → No
(f) Have you ever been convicted by a Court of law for any offence? → No
(g) ...debarred from any Examination...? → No
(h) ...disqualified by any Public Service Commission...? → No
(i) Is any case pending against you in any Court of Law...?
(j) ...case pending against you in any University...? → No
अगर आपको arrest नहीं किया गया, आपके खिलाफ charge-sheet दाखिल नहीं हुई, आपको court में accused के रूप में prosecute नहीं किया गया, कोई conviction/fine/detention/bound down नहीं हुआ, तो सामान्यतः (a) से (h) तक के answers “No” होंगे, बशर्ते इनके संबंध में आपके खिलाफ कोई अलग proceeding न हो।
सबसे important question (i) है — “Is any case pending against you in any Court of Law?”
Answer all questions NO.
a) If you was not arrested in that case after lodging FIR , then mention No. However if was arrested then give YES
with the remark no charge sheeted due to being innocence.

c) NO
d) NO
e) NO
f) NO
g) NO
h) NO
i) NO
j) NO
- Since, there is no pending case against you including that case under section 376 , then police will give a positive
report
Based on the facts stated by you, the most important point is that FIR No. 260/2023 was registered against your brother, whereas your own name was subsequently deleted during investigation and you were not charge-sheeted. Therefore, you should not automatically answer “Yes” merely because your name appeared in the original FIR.
However, because the attestation form specifically asks about arrest, prosecution, detention, etc., the exact answer depends upon what actually happened to you personally—not what happened to your brother.
For your particular form, the position would ordinarily be:
Column
What you should answer, based on the facts presently stated
(a) Have you ever been arrested?
No, if you were never arrested in FIR 260/2023 or any other case.
(b) Have you ever been prosecuted?
No, if no prosecution was initiated against you and you were not charge-sheeted/put on trial.
(c) Have you ever been kept under detention?
No, if you were never detained.
(d) Have you ever been bound down?
No, unless a court/police authority actually passed a binding-down order against you.
(e) Have you ever been fined by a Court of Law?
No, assuming no court has ever imposed a fine upon you.
(f) Have you ever been convicted by a Court of Law?
No, assuming you have never been convicted.
(g) Debarred by educational authority?
No, unless this has happened.
(h) Debarred/disqualified by PSC/SSC?
No, unless this has happened.
(i) Is any case pending against you in any Court?
No, if you are not an accused/person against whom a case is pending. The fact that your brother's case is pending does not make it a case pending against you.
(j) Case pending before educational authority?
No, assuming none is pending against you.
The Supreme Court has specifically emphasized in Avtar Singh v. Union of India that an attestation form must be answered according to what the particular question actually asks, and that an employer cannot treat information as suppressed when the form did not require that information. At the same time, where the form specifically asks about arrest or prosecution, the candidate must answer truthfully. Indian Kanoon
There is an important distinction here between being named in an FIR and being arrested/prosecuted. If your name appeared in the FIR but the police investigated and removed your name from the final charge-sheet, that does not by itself mean that you were “prosecuted.” Similarly, if you were never arrested, you cannot answer “Yes” to the arrest question merely because you were named in the FIR.
However, I would recommend checking the final police report/charge-sheet and the court order taking cognizance, if any, before signing the attestation form. If the final police report specifically records that your name was deleted/not sent up for trial, retain that document. It can be extremely useful if the department subsequently conducts character verification.
One important caution: do not write “No” to every column simply because you were ultimately removed from the case without first verifying whether you were ever arrested, detained, bound down or otherwise proceeded against individually. The Supreme Court has made clear that where a form specifically asks for such information, inaccurate disclosure can itself create employment complications. Indian Kanoon
If the form has an additional column asking whether you have ever been “involved in any criminal case,” “named in an FIR,” or whether any FIR was registered against you, that is different from the questions reproduced above. In that situation, the original FIR naming you may need to be disclosed with an explanatory statement that you were subsequently exonerated/deleted from the charge-sheet and no prosecution is pending against you.
Also, if this is a police, CAPF, armed forces, judicial, or other sensitive government post, the department's specific verification rules may impose additional requirements beyond the general attestation form. The precise recruitment notification and the complete attestation form should therefore be checked before submission.
On the facts presently supplied, if you were only named in the FIR, were never arrested/detained/bound down, were never prosecuted or convicted, and your name was deleted from the final charge-sheet, the answers to (a)–(j) would ordinarily be “No,” subject to verifying the actual police/court record and the exact wording of the complete form.
