• Can complaint registered against me affect my govt job verification?

I am living in Mumbai. I was married in Dec 2015 and both were living separately since March 2016 due to difference our parents tried to reconcile but it didn't work out. In Oct 2017 her parents came and said we should go for divorce we agree. Then after few days I received a call from women's cell (SATARA) stating that my wife has registered a complain there and they want to hear our side. So we went there after discussing the issue councillor said we should go for mutual divorce on which both agreed. We returned everything we got at the time of marriage. Got divorced in June 2018. My question is whether any FIR was filed by her at that time or not? I was not arrested only Councillor said if didn't visited there 498a would have been lodge against me. Now the divorce has been granted I paid alimony everything has been settled. At the time of divorce my ex wife was saying she will not spare me. So I asked women's cell officer what she can do now. She said she can't do anything now. Is there any chance the FIR is still pending? I was not arrested no chargesheet filed etc. Now I am selected in govt job will there be any problem regarding police verification? My wife filed a complaint in women cell SATARA district (Maharashtra) as she lives there and I live in Mumbai. Divorce also taken place in satara. So my local police station was not involved in the whole incident. Will there be any problem In police clearance? Please answer my this query I also checked SATARA District court websites regarding any pending cases if any against me. But there is no case against me except marriage petition which is already disposed off.

See if there was only.complaint and no further action taken there was criminal case against you , no charge sheet then surely there is no FIR feel free there won't be any issue in the verification.

Since there is no criminal case pending mere FIR won't effect the verification.

If any such complain was filed than , police would have issued you notice and women cell and since the issue has resolved by the advise of WC , police would have filed close report. Hence, complain pending.

The complaint registered with the Women's Cell is not in the nature of an FIR. They can only make reconciliatory efforts to settle the dispute between the couple.  Moreover, Police Verification will also have to be carried out by your local Police Station.  In my opinion, thus there should be no problem in the Police Verification and you have nothing to be worried about.

No need to worry, the case must have been closed by the women cell. In fact no FIR must have been lodged and hence there Is nothing to worry. You will face no problem in police clearance.

I don't think any problem will be there. During mutual divorce you must have included a condition that any pending criminal case will be quashed mutually by her and no new case will be filed by her after the divorce decree

If an FIR is registered against you, then you will have to mention the same in your goverment form.

In addition to this you will also have to mention the criminal case pending against you.

The governement department cannot hold you back till the case is decided against you and if they do not select you on the basis of pending criminal case, you may file a Writ in the concerned High Court.

If there is no FIR pending against you then there is no problem about this.

In fact your marriage has already been dissolved by a decree of divorce hence any new case that she may propose to file now against you will not be maintainable.

The matrimonial disputes will not affect the job opportunities.

You can remain silent about it since you have not been served with any summons or notice in this regard so far.

The department ask following questions

  1. Have you ever been arrested.
  2. Have you ever been prosecuted
  3. Is their any case pending against you in any court of law
  4. Have you ever been fined by court.
  5. Have you ever been debarred from any training etc
  6. Have you ever been convicted by any court for any offence.

You would have to give information on basis of your knowledge and belief. So at first if you go sincerely through these questions you will find that there is no question like “ have you ever been accused for any crime”?…FIR merely means that you are being accused..So even a F.I.R. is lodged against you ..It does not mean that you need to worry. Your worry starts if you are being chargesheeted by investigating agency because then the matter comes under point 2. However if you are being arrested after F.I.R. then clearly mention it in form. Secondly it should be on your both addresses ..Permanent And working .. the whole process is meant to check their criminal records if any .So if God forgive .Even if complaint is lodged. But if you are not being chargesheeted..Then you are as free as flying bird is.
