Does township of thermal plant come under factories act 1948? There is problem of lump falling from the ceiling of quarters of township of thermal plant where I am residing. Due to the pressure of executive association structure assessment was done and report is received on 20/06/2018 but management is saying on 27/10/2018 report is under examination in RTI reply . Under which act safety of employees residing in quarters of township can be ensured.

According to Section 2(m) of Indian Factories Act, Factory means "any premises including the precincts Thereof

i. Whereon ten or more workers are working, or were working on any day of the preceding 12 months and in any part of which is manufacturing process is being carried on with the aid of power as is ordinarily so carried on; or

ii. Whereon twenty or more workers are working or were working on any of the preceding 12 months and in any part of which a manufacturing process is being carried on without the aid of power pr is ordinarily so carried on.

Dear Client,

Act applies to regulate labour in factories and condition INVOLVING HAZARDOUS PROCESSES, township has nothing to do with it.

For any mishap due to fall of quarter`s ceiling, employer is liable under Indian Penal Code.

Complain to labor ministry or appeal to labor commissioner for ordering repairs.

Sir the township is not under the factories act write a letter to concerned authority for repaid of the residence citing the danger and ask for immediate action.
