Hello,

I would like to suggest you never give other the chance to gain possession of the said property.

Let him file the documents vefore the court to back his claim.

Valuation of property is done based on circle rate issued by govt from time to time

2) in suit for partition you have to stamp duty based on market value of your share in property

Firslty, whenever a suit has been filed in any court in accordance with its pecunary jurisdiction then at the time of filing it you may file it even in the basis of the rough idea.

Secondly, but, if the court seems fit to let it assert its actual value then it may order for the Tehsildaar to do the same.

Thirdly, you please somehow try to find out the Khasra No. of that area, and then go to the old record room of the land owing agency there must be something in their record whcih may have your anscestors name.

The valuation for the suit of a property can be done based on the government circle rates/jantari value based on that court fee can be paid.

Every survey number in the urban and rural land has assigned value by the government same can be used for the purpose of the valuation.

Since in absence of any document mutation, electricity bill, tax receipts, absence of any village records the possession can be only the saviour like the statements of the neighbour, address in the Identity cards , parivaar register to establish adverse possession over the land.

The calculation shall be made on the basis of market value of the property, the old system of calculating the kist value of the agricultural property has been abolished in almost all the states of the country.

However since this is a state subject, you may get confirmation of the court fee to be paid as per the prevailing rates as per the suit valuation act of your state.

For court fee, the state court fee and suit valuation act shall be a proper guidance.

If you are in confusion or doubt about it you can enquire the same from your advocate or a different advocate in the local.
