My father has some agricultural lands in Hooghly District, West Bengal. One nearby farmer has a big agricultural land near to our house. It is a patta land. On the other way, my father also has one same-sized agricultural land near to this farmer's house. My father and the other farmer want to exchange these lands for convenience. But his land is patta land. According to our knowledge, in West Bengal patta land is non- transferable or non-saleable property. Will this kind of direct exchange be legally possible? Is there any work-around or other solution so that my father and the farmer can go for exchange?

Who is the owner of that patta land?
See, transfer of patta land by any way takes a good amount of time so the procedures ate time consuming. Besides, there ate also chances of becoming victim of fraud, etc. So if you want to exchange your land with the other owners land then you need to talk with the Owner and know whether he/she is also interested in the same or not. Then the actual procedure will begin.
The name of owner ( or should I say possessor?) is subal chandra das. . Khatian no-442, Daag No(Plot no) of the patta land- 2078, Total area of the plot - 0.17 acres, District- Hooghly, Block-Goghat-2, Mouja- Satberia. The same record are also available in WB land & land reform website(banglarbhumi.gov.in). This farmar stays in same village where my parents also stay. So, there is less chance of any frudent activities. This farmar is interesed to transfer his patta land in exchange of our agricultural land near his residence(our land is not patta land). My father already spoken to his farmer and he is very much interested. Now only problem is legal compilcations as his land is PATTA LAND. 1)What is the procedure to procure /buy/exchange/get transferred his patta land to my father's name ? Is it at all possible? 2)If this is not possible, can my father take lease of this patta land for 99 years (in exchange , my father will also give lease of his land to this farmer for 99 years)?

Is this land settled by govt. in the farmer than restriction is valid under sec 49 of West Bengal Government Land (Regulation of Transfer) Act, otherwise no such restrictions.

The farmer got is land from Government . West Bengal Govt distributed lands to landless farmer 14-15 years ago . During that activity , he got his patta for this land. Online Details (ROR/Parcha) is available for this land. Than its not possible otherwise govt. shall take back the land as violation of settlement terms sec 49 of Act.
