• Seeking help for divorce

Myself M. Sonya.
I want divorce from my husband of 10 years.
I am living in a separate city after 1½ months of marriage. (married on 2007)
We have severe incompatibility issues which is irreconcilable.
I have gone through severe mental depression and developing suicidal tendencies.
I was asked for dowry. 
My father gave 1 lakh after 2 days of marriage and also a piece of land for dowry.
I was harassed mentally and physically by my in-laws.
When I tried to commit suicide, I was assured of divorce by my husband and in-laws.
But later they denied.
I was asked to come back else face legal action against me and my family.
I am totally fed up now.
All I want is a divorce and start a new life.
please help me and guide me

Hi, either you can persuade your husband to file a mutual Divorce petition .. Mutual divorce will be granted in 6 months .. If he do not agree you can file contested divorce on the grounds of mental Cruelty ..

ask for mutual consent divorce, and if that is not possible file petition in the city where you living for divorce. Also file maintenance petition. if you want to teach lesson to your husband file a fir against him for domestic violence and dowry.

If your husband too is ready for a divorce, you both may apply for divorce by mutual consent.

Mutual consent divorce is the quickest and least cumbersome way for you, to move out this marriage.

In case he does not gives his consent for mutual consent divorce, you mat contest a divorce against your husband.

Hello,

Yes you can defined file divorce on the ground of cruelity. You can file the same at the place where Marriage took place, where you two last resided together or where he is residing.

The same will take around 2 years and you can claim alimony and the amount and land that you gave to them.

Under such and present circumstances it is suggested that you can take divorce - it would be better if a divorce on the basis of mutual settlement is agreed however if that's not a possibility in that case - either you file DIvorce on the basis of cruelty or go for taking an ex-parte divorce*

Hi,

You may file a divorce petition in the family court as you are living away from your home her more than 2 years.

If you are not an earning member you may file a petition under section 125 CRPC car maintenance of yourself and for the legal Express after the due conciliation the family code bill give the degree of divorce.

1. Is your husband ready for mutual consent divorce? If the answer is yes then the marriage can be amicably dissolved in less than 6 months by filing a joint petition in the court.

2. If, however, he is not willing to go for MCD then the only remedy for you is to file a petition for divorce unilaterally which your husband can contest in the court. It will take longer than MCD and you will have to prove your allegations of cruelty.

Since you are living separately away from your husband for around 10 years, this indicates that the marriage is dead and no chances of reconciliation.

You may apply for divorce on the same grounds besides making pleadings of cruelties due to dowry demands and abetment to suicide due to their cruel acts.

You can even plan to file DV case against the, including dowry harassment criminal complaint.

This will make them to come down for negotiations and divorce on mutual consent.
